Divorce (uncontested)

A simple divorce is also commonly referred to as an uncontested divorce which is when you and your ex both agree to divorce.

Couples can get divorced for any of the following reasons:

  1. Cruelty

    This is when one spouse treats the other with any type of harm or abuse whether it is mental or physical.

  2. Adultery

    This is also referred to as cheating or when one spouse has an affair. It’s important to understand suspicion is not enough to prove adultery, and can be difficult to prove in many cases.

  3. Separation

    This is the most commonly use grounds for divorce. When the couple has been living separate and apart for a period of at least one year. Separate and apart is not only limited to living in different houses, it could mean living in the same house but sleeping in different bedrooms and not eating meals together or not attending social events with each other.

The following criteria must be met to complete an uncontested divorce

  1. You and your spouse must have lived separate and apart for one year, and
  2. If there are children, then there must be reasonable arrangements with child support that are in place
